However, patients will not be accountable on how the remains are handled. The patient’s physician, in accordance to law, must properly dispose or store the tissue.

The law goes into effect September 1, 2017, however the issue of fetal burial is on tied up in the courts, therefore it’s on pause.

Many hospitals already bury fetal remains; while some dispose of the remains in “sanitary landfills,” repositories for medical waste. Hospitals and clinic that does not bury or cremate fetal remains after miscarriage or an abortion is subject to fines or the loss of their license.
